Spousal Maintenance (Alimony)
This is Colorado’s term for what is commonly known as “alimony,” which refers to the amount one party in the divorce pays the other spouse.
Parenting Time
The court divides parenting time based on the best interests of the children. A judge will consider factors, such as a child’s relationship with his or her parents, and will make a decision. They may also appoint a neutral third party to investigate and make recommendations.
Division of Property and Debts
Whether you’re getting a legal separation or divorce, the court must still divide your assets and debts. Colorado courts follow a fair division of marital property, though this does not always mean 50/50 division.
Child Support
Generally, the court calculates child support using a formula that considers each parent’s income, as well as expenses like child care, health insurance, and medical expenses. In some circumstances, the court may deviate from the formula.
Attorney Fees
If there is a significant income gap between the two parties, the court may order one party to pay the other’s attorney fees. These can sometimes be awarded in advance.
