Gain Clarity in Child Dependency and Neglect Cases
Choose an attorney who will advocate for your rights.
Child Dependency and Neglect Cases Can Be Scary
One of the worst nightmares a parent can face is receiving notice that a case has been opened against them by Child Protective Services or CPS. In Colorado, these investigations are handled by the Department of Human Services (DHS). They are called “dependency and neglect cases,” and can refer to minor allegations of child abuse or neglect, or court proceedings where termination of parental rights becomes a possibility.
When parents are faced with dependency and neglect allegations, they are often terrified and unsure of what to do next. If you find yourself in this situation and need guidance, One Accord Legal is here to help.
One Accord Legal Can Help Alleviate Your Fears
If you are under a DHS investigation, you likely have a lot of questions. We can help you find answers. Our experienced Colorado-based team will work with you to explain the process, the findings of the case, and, if further action is taken, advocate for you in the courtroom.
It’s important to remember that the goal of a dependency and neglect case is to equip parents with the skills and help they need to provide safe and loving care to their children. Asking for help from an attorney or calling a crisis line does not compromise your case and can even show a judge and DHS team that you are able to recognize when you need help.
What the DHS Process Might Look Like
Depending on the seriousness of the allegation, DHS may open an immediate court case. Most of the time, though, if a call has been made to Colorado’s child abuse hotline, a caseworker will be assigned to investigate.
No matter the situation you find yourself in, One Accord Legal can help you understand your options, and will advocate for your parental rights.
A DHS investigation might look like:
A visit to your home.
The caseworker will visit your home and conduct interviews with your child and yourself.
A determination by the caseworker.
The caseworker will determine whether there is evidence of abuse of neglect. If the caseworker determines that the allegation is “unfounded” or “inconclusive,” the investigation is closed, and no further action is taken.
A report of “founded” finding.
If the caseworker finds evidence of abuse or neglect, you will receive a report of a “founded” finding. You will also receive notice that your name has been entered in Colorado’s TRAILS database, which is used for background checks. If this happens, you can appeal the entry and request that your name be expunged from TRAILS.
A proceeding in Colorado juvenile court.
The caseworker can also open a formal dependency and neglect case in Colorado juvenile court, where hearings will be held to determine a treatment plan in your child’s best interests.
