Child Dependency and Neglect Cases Can Be Scary

One of the worst nightmares a parent can face is receiving notice that a case has been opened against them by Child Protective Services or CPS. In Colorado, these investigations are handled by the Department of Human Services (DHS). They are called “dependency and neglect cases,” and can refer to minor allegations of child abuse or neglect, or court proceedings where termination of parental rights becomes a possibility.

What the DHS Process Might Look Like

Depending on the seriousness of the allegation, DHS may open an immediate court case. Most of the time, though, if a call has been made to Colorado’s child abuse hotline, a caseworker will be assigned to investigate.

A DHS investigation might look like:

A visit to your home.

The caseworker will visit your home and conduct interviews with your child and yourself.

Custody

A determination by the caseworker.

The caseworker will determine whether there is evidence of abuse of neglect. If the caseworker determines that the allegation is “unfounded” or “inconclusive,” the investigation is closed, and no further action is taken.

Child Support

A report of “founded” finding.

If the caseworker finds evidence of abuse or neglect, you will receive a report of a “founded” finding. You will also receive notice that your name has been entered in Colorado’s TRAILS database, which is used for background checks. If this happens, you can appeal the entry and request that your name be expunged from TRAILS.

The caseworker can also open a formal dependency and neglect case in Colorado juvenile court, where hearings will be held to determine a treatment plan in your child’s best interests.
